Applicable to All Lifestyle Activities and Tours Arranged by Casa Rica Realty.
Participation in any lifestyle activity or tour arranged through Casa Rica Realty is entirely voluntary and undertaken at your own risk. By booking or participating in any activity, you acknowledge and agree to the following terms:
Acknowledgment of Risks.
Participating in lifestyle activities and tours — including but not limited to ATV riding, horseback riding, hiking, yoga, surf lessons, water sports, cultural tours, and transportation — involves inherent risks. These risks include, but are not limited to: falls, collisions, weather conditions, wildlife encounters, equipment failure, illness, property damage, serious injury, permanent disability, or death. You voluntarily assume full responsibility for these risks and any resulting consequences.
Waiver and Release of Liability.
You hereby waive, release, and discharge Casa Rica Realty, its owners, employees, agents, affiliates, and representatives from any and all claims, demands, causes of action, or liability for personal injury, illness, death, property damage, or other losses arising out of or related to your participation in any activity — even if caused in whole or in part by the negligence of Casa Rica Realty.
Third-Party Provider Disclaimer
Casa Rica Realty does not operate or provide any of the activities or tours directly. All activities and tours are delivered by independent, licensed third-party providers. Casa Rica Realty acts solely as a facilitator for booking purposes and assumes no responsibility or liability for the operation, safety, scheduling, cancellations, quality, or outcomes of the activities. By participating, you acknowledge that any agreements, waivers, or disputes regarding the activity are solely between you and the independent provider.
Assumption of Fitness and Compliance.
You represent that you are physically and mentally fit to participate and are not under the influence of alcohol, drugs, or any condition that could impair your ability. You agree to comply with all applicable rules, instructions, laws, and safety measures, and to use all required protective equipment properly.
Medical and Insurance Responsibility.
In case of an emergency where you are unable to consent, you authorize the activity provider and/or Casa Rica Realty to seek medical assistance on your behalf, and you accept full responsibility for all related costs. You acknowledge that Casa Rica Realty does not provide medical or travel insurance and that securing appropriate coverage is solely your responsibility.
Financial Responsibility for Damage.
You accept financial responsibility for any damage you cause to property, equipment, or third parties during your participation, beyond ordinary wear and tear.
Photography & Promotional Use.
You grant Casa Rica Realty and its partners the right to use any photographs or videos of you taken during the activity for promotional purposes, without compensation.
Jurisdiction
These terms are governed by the laws of the Republic of Costa Rica, and any disputes shall be subject to the exclusive jurisdiction of the courts of Nicoya, Guanacaste.
By booking or participating in any activity or tour through Casa Rica Realty, you confirm that you have read, understood, and agreed to these terms and conditions.
